Domanda: le linee guida del BEREC tengono in considerazione gli obiettivi della Gigabit Society, considerando che classificano come VHCN reti che non vanno neanche a 100 Mbps?

The EECC (Art. 2(2), Rec, 13) defines the term ‘very high capacity network’ and also the baseline scenarios that need to be considered for the determination of the performance thresholds of criteria 3 and 4 and the draft BEREC Guidelines follow exactly this approach. However, the EECC does not define that these performance thresholds should be set based on the Gigabit Society target by the European Commission.
Parafrasi: il nuovo codice delle comunicazioni elettroniche, che è il documento che dà mandato al BEREC di stabilire queste linee guida, non fa riferimento agli obiettivi Gigabit Society, quindi no.
Domanda: le linee guida, e in particolare i paragrafi 19 e 20, definiscono una categoria "fixed wireless VHCN" per distinguere le reti wireless che sono Gigabit-capable?

The draft BEREC Guidelines (paragraph 19) define the categories 'fixed very high capacity networks' and 'wireless very high capacity networks', however, they do not introduce the category 'fixed wireless very high capacity networks'. Paragraph 20 of the draft BEREC Guidelines solely makes clear that a 'wireless very high capacity network' may also meet the performance thresholds of criterion 3 (e.g. in case of FWA) which applies to networks providing a fixed-line connection and then such a network may be considered to be equivalent to a 'fixed very high capacity network'.

Domanda: è corretto dire che qualsiasi rete wireless (anche FWA) con la fibra ottica fino alla BTS è da considerarsi ad alta capacità indipendentemente dalla velocità che offre?
According criterion 2 of the draft BEREC Guidelines (paragraphs 16 and 63), any network providing a wireless connection with a fibre roll out up to the base station qualifies as a very high capacity network and it does not need to fulfil further criteria. Therefore, if a network based on FWA provides a wireless connection criterion 2 is applicable and if it fulfils criterion 2 (fibre roll-out up to the base station) then it qualifies as a very high capacity network.
