AVM Computersysteme Vertriebs GmbH, known for its Fritzbox routers, is said to be violating existing WLAN patents of the Chinese company Huawei and is now faced with a possible sales ban after losing its first legal dispute. The manufacturer from Berlin wants to appeal against a current court ruling and appears calm.
AVM threatens to ban the sale of Fritzbox routers
As Golem reports, Huawei accuses the Berlin company AVM of violating two of its existing WLAN patents. Huawei has already filed two lawsuits for this reason, one of which was dismissed. A second procedure was approved by the Munich I Regional Court in November 2023, which concerns the so-called signaling fields, which in the Wi-Fi 6 standard indicate whether a packet is transported to one or more recipients.
Judges reject AVM’s objections
The judges before the regional court rejected AVM’s objections regarding procedural errors as well as the reference to license negotiations under FRAND aspects. FRAND (“Fair, Reasonable and Non-Discriminatory Terms”) is intended to prevent stalling tactics from occurring during negotiations.
The regional court sees a sales ban as justified
The Munich I Regional Court rules against AVM and sees a sales ban as justified, writes Heise.
